Texas' Gay Marriage Ban May Have Banned All Marriages

This is amusing. Texas' gay marriage ban may have banned all marriages. The clause in question (clause B) is: "This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage." I'm sure this is just a mistake that will be corrected, but it's amusing (unless of course you're affected by it).

While it may never be interpreted to invalidate "official" heterosexual marriage, I think it has a shot at invalidating common-law marriage in Texas, and there's a great deal of previously-settled law related to that. The fun thing is that this is an amendment to the state constitution, so it's a non-trivial fix. I hope it causes lots of bigoted assholes lots of headaches defending it.
